Ashcraft & Gerel has focused its practice on people injured by medical malpractice, defective or dangerous products, automobile accidents or workplace accidents.
 
For example, we handle claims for:

  • People who are injured as a result of a defective Medtronic Sprint Fidelis defibrillator lead. People sustaining heart attacks and death alleged to be associated with the diabetes medication, Avandia (Rosiglitazone), babies who have suffered birth defects consisting of Persistent Pulmonary Hypertension or PPHN as a result of their mother taking an anti-depressant called a Selective Serotonin Reuptake Inhibitor or SSRI during pregnancy, primary pulmonary hypertension caused by the prescription diet drug Fen-Phen and other dangerous, defective and unsafe drugs, medical devices and consumer products. These are called product liability claims. An example of a consumer product that has resulted in product liability litigation is the recent Peter Pan and Great Value Peanut Butter recall arising out of Salmonella contamination. Drug and medical product liability claims that our lawyers have prosecuted include Baycol, the cholesterol lowering drug, found to cause serious injury and death due to a muscle condition called rhabdomyolysis, another cholesterol lowering drug called Crestor , found to cause kidney damage and rhabdomyolysis, and Propulsid , which is a heartburn medication withdrawn from the market after being linked to hundreds of heart rhythm abnormalities and many deaths. Three drugs recently found to be dangerous and that have prompted many lawyers to file lawsuits are Vioxx , Celebrex and Bextra. And if the FDA carries through on its recommended approval of Pargluva, there likely will be a huge number of lawsuits associated with the heart and stroke complications that were revealed in pre-approval studies. The FDA recently issued warnings concerning the Ortho Evra transdermal contraceptive patch, known to contain substantially more estrogen than other birth control pills, thereby subjecting users to an increased risk of blood clots, deep vein thrombosis (DVT), pulmonary embolus, phlebitis, heart attacks and strokes. Medical product liability lawsuits also include dangerous drugs such as Fosamax and Other Bisphosphonates, which have been found to cause osteonecrosis of the jaw or ONJ, Trasylol, which is a drug used during heart bypass surgery to lower blood loss, but which has now been found to cause kidney damage, heart attacks and strokes and Ketek, an antibiotic used for respiratory infections, which has now been shown to cause liver damage. Investigators recently traced contaminated human tissue and organ transplants to organ banks that failed to follow FDA protocols. Other relatively recent medical product liability claims involve (1) contaminated Olympus bronchoscopes, which have caused many people to become seriously ill from lung infections following broncoscopy, (2) MRI dye lawsuits - gadolinium based contrast agents in MRIs and MRAs, such as Omniscan, which have been found to cause a serious skin disorder called nephrogenic systemic fibrosis (NSF) or nephrogenic fibrosing dermopathy (NFD), and (3) failures associated with the stent-graft that is part of Guidant's Ancure endograft system. Guidant has also, as of June, 2005, recalled 50,000 defective cardiac defibrillators (sometimes called an ICD or implantable cardioverter defibrillator) that have, to date, resulted in at least 45 failures and at least two deaths.
  • People suffering from hemorrhagic stroke caused by the chemical additive Phenylpropanolamine or PPA , a common ingredient in over the counter weight loss drugs as well as cold and cough medications and people sustaining heart attacks and strokes from ephedra contained in dietary supplements.
  • People suffering from liver damage caused by the prescription anti-depressant Serzone .
  • People who have sustained severe eye damage from an infection after using Bausch & Lomb brand Renu with MoistureLoc contact lens solution .
  • People suffering from serious side effects and death caused by the prescription diet drug Meridia .
  • Victims of Zelnorm (Tegaserod), a drug used to treat irritable bowel syndrome or IBS and constipation, which has now been removed from the US market after discovery of an increased rate of heart attacks and strokes.
  • Babies who suffer birth injuries, brain damage or cerebral palsy due to birth trauma or medical malpractice .
  • Children who suffer lead poisoning and brain damage from ingesting lead paint chips or dust . Lead paint has recently been found on children's toys imported from China, and this has caused a huge recall.
  • People who sustain blood clots and heart attacks caused by drug eluting stents implanted in their arteries .
  • People who suffer injuries due to medical malpractice by physicians, hospitals and other health care providers. These claims include nursing home and senior citizen medical malpractice claims , one of modern society's most troubling areas.
