Half Million Dollar Lawsuit Settlement By A&G’s Palmer Foret and Craig Brown
This case exemplifies the product of cooperation between lawyers in a law firm having multiple offices in different jurisdictions. Two A&G lawyers, in different offices of the firm, teamed up to bring about an excellent result in this automobile accident lawsuit. L. Palmer Foret in Ashcraft & Gerel’s Rockville, MD office, with the assistance of Craig Brown in the firm’s Alexandria, VA office, settled an automobile accident lawsuit filed in Fairfax County, Virginia for $500,000. A&G’s clients (husband and wife) were driving home one evening when they were struck by a drunk driver, resulting in serious injuries. They were driving on a main road when the vehicle driven by the drunk driver ran a stop sign on a side road and struck the driver’s side of our clients’ vehicle. The defendant drunk driver tested an hour and a half later at a 0.12% blood alcohol level, well above the legal limit. The defendant was driving an AVIS rental car, which had minimum insurance limits, and in addition had his own underinsured motorist insurance coverage.
The husband suffered fractures of his right leg, left knee cap, and two fingers of his right hand. He also had injuries to both lungs (pulmonary contusions). He was in the hospital almost a month, during which time he underwent surgery on his leg. Postoperatively he developed a deep vein thrombosis (blood clot) and was required to undergo an additional operation to insert an umbrella/filter to prevent the possible development in the future of a pulmonary embolus. Following his discharge from the hospital he was required to undergo additional medical treatment, including two surgeries on the fractured fingers and to remove the umbrella/filter that had been implanted. He was off work for over three months.
The wife suffered various injuries to her chest, leg, knee, ankle and foot, missing 2 weeks of work. Needless to say, she also experienced considerable anxiety over her husband’s health.
There was limited insurance coverage. The case settled at mediation for $500,000, which was close to the limit of all available insurance coverage. Kudos to Palmer Foret and Craig Brown for a job well done.
