Understanding Your Rights under the Defense Base Act

Intended to protect workers who serve the U.S. government abroad, the Defense Base Act grants you certain rights – and it is important that you are familiar with your rights under this Act.

Just like standard workers’ compensation, the Defense Base Act provides benefits including:

You are eligible for these benefits regardless of whether the injury occurred while you were on the clock.

By law, your employer must offer workers’ compensation insurance for employees if they meet the aforementioned requirements. If your employer fails to pay you the full amount you are owed or fails to maintain coverage, you have the right to seek legal action and sue for tort damages. If your employer cannot or does not cover the cost of your injury, they could face criminal penalties including fines and/or jail time.

Keep in mind that you only have one year to file a claim and 30 days to inform your employer of your injury in writing.
