Side or Curtain Airbag Litigation

In the March 2004 Journal of Trauma, Injury, Infection and Critical Care,  it was reported that people  in cars equipped with head protecting side airbags had a 75% lower risk of head injury after a side collision. With over 25% of all accidents arising from side impacts, this represents potentially millions of avoidable head injuries. While the technology to equip all new cars with this potentially lifesaving equipment has existed for over a decade, many auto manufacturers either willfully refuse to install them in their vehicles or only offer this “added protection” as an exclusive option on its most expensive line of vehicles. At Ashcraft & Gerel we believe safety should never be an “option” for auto manufacturers. Fortunately, in 2009 the National Highway Traffic Safety Administration (NHTSA)mandated that all vehicles be equipped with side airbags with a four year compliance window for manufacturers to “phase in” the devices. Unfortunately, many auto manufacturers have failed to take the next reasonable step of including such protection for backseat passengers who are often children. Not only is this illegal according to the National Highway Traffic Safety Administration, it can put you and your family in serious danger in the event of an auto accident.
