David L. Bayne, Jr. has been a valued member of the Ashcraft & Gerel team for more than 19 years. An impressive background in criminal law and public defense, as well as an avid interest in constitutional rights, informs his leadership in the firm’s workers’ compensation practice area. A force to be dealt with in the courtroom, Mr. Bayne is a tenacious advocate for each and every one of his clients.
Mr. Gensemer has a knack for winning on behalf of his clients. He has won favorable jury and court verdicts ranging from tens of thousands of dollars to a verdict of $10 million in the Prince George’s County circuit court.
Recently, Mr. Gensemer obtained a judgment of $462,000 on behalf of a client in federal court who was injured when his vehicle was struck by a tractor-trailer.
In a criminal defense case, Mr. Gensemer represented a Prince George’s County father who severely injured his leg when a drunk driver struck his vehicle, recovering for his client full policy limits from the respective insurance company representing his client and the owner of the striking vehicle.
Other notable cases include an eight-figure verdict on behalf of a minor who had been sexually assaulted by a foster father, and Mr. Gensemer’s representation of an individual in a high-profile, triple-murder case in Prince George’s County, Maryland.
While in law school, Mr. Gensemer served as Dean’s Fellow in research for Jamie Raskin, now a member of the Maryland Senate.
Mr. Gensemer also participated in a full year of Criminal Justice Clinic, where he worked half a year as a criminal defense attorney in Montgomery County and the remainder with the Anne Arundel County State’s Attorney’s Office.
Mr. Gensemer also received a grant from the Equal Justice Foundation of the American University Washington College of Law for his work in the Alexandria Public Defenders’ Office during the summer of 2001.
Outside the Courtroom
Mr. Gensemer is married with two young children and enjoys playing basketball in leagues through the Montgomery County Recreation Department. He is also on the executive board of his neighborhood civic association, and an active member of both the American Civil Liberties Union and the Southern Poverty Law Center.
